Buddha to Buddha B.V. (hereinafter: Buddha to Buddha) offers a web shop via the website https://www.buddhatobuddha.com/nl/. Every day we receive a large number of orders from customers and process personal data. Your privacy is very important to Buddha to Buddha. That is why we comply with the General Data Protection Regulation (GDPR).

Our privacy and cookie statement in brief

When processing personal data, we comply with privacy legislation. This means that we:

  • Lay down our purposes clearly in this privacy and cookie statement before processing your personal data;
  • Store as little personal data as possible and only store those data that are required for our purposes;
  • Ask explicit permission for the processing of your personal data, if permission is required;
  • Take the required security measures to protect your personal data. We also impose these obligations on parties that process personal data on our behalf;
  • Respect your rights, such as the right to inspection, correction or deletion of any personal data of yours that we have processed.

For what purposes do we use your personal data?

Through your use of our web shop, we obtain various types of personal data from you. For each purpose, we will indicate what data we obtain from you, for what purpose we process this data and for how long it will be retained. If you have any questions, or would like to know exactly which of your data is stored by us, please contact Buddha to Buddha. You can find our contact details at the bottom of this privacy statement.

When you send us an email, contact us by telephone, send us a WhatsApp message or contact us in any other way, you accept our offer to contact us (performance of the agreement).
To that end, we process the following personal data:

  • name;
  • email address;
  • any information you enter yourself as the content of a message.

We will retain your data for as long as is necessary for this contact or up to three months after we last had contact with you, as we want to be sure that we have handled your question or complaint properly.

Placing and handling of orders
If you place an order on our website, you provide certain data. We need this data because of the purchase agreement that is concluded between you and Buddha to Buddha (performance of the agreement).
To that end, we process the following personal data:

  • name;
  • email address;
  • telephone number;
  • invoice address;
  • delivery address;

We will retain this data for up to two years after the purchase was made. We retain some data for longer if we are required to do so by law (for example, because of the tax-related retention obligation).

Creating a customer account
It is possible to create a customer account with us. There are many advantages to creating an account, such as faster order processing, registering multiple addresses and order tracking. To that end, we process the following personal data:

  • email address;
  • login details.

We will retain your personal data until you close the account, or for up to two years after you last logged in to your account. In such cases, we will assume that you no longer wish to make use of our services. We retain some data for longer if we are required to do so by law (for example, because of the tax-related retention obligation).

Managing your customer account

Once you have created an account, you can decide which information you want to add to the account (performance of the agreement). You can create your own profile within your account. The account also contains an overview of your orders. To that end, we process the following personal data:

  • email address;
  • login details;
  • name;
  • address details;
  • telephone number;
  • personal interests.

We will retain your personal data until you close the account, or for up to two years after you last logged in to your account. We retain some data for longer if we are required to do so by law (for example, because of the tax-related retention obligation).

Use of the retailer portal
We provide a B2B portal on our website to manage your orders and data. You can register via your account manager and we will then create a portal for you. In order to offer you this account environment, we process your personal data, after which you can then make your purchases (performance of the agreement). To that end, we process the following personal data:

  • user name;
  • Password;
  • email address;
  • Company name;
  • name;
  • address details;

  • name;
  • email address.

We will retain your personal data until you unsubscribe from the newsletter. You can unsubscribe from the newsletter at any time. Each newsletter contains a link to unsubscribe.

Job applications

Have you responded to one of our vacancies or have you submitted an open application? If so, we will process your personal data in order to handle your application and to prepare for the conclusion of an employment contract if you are successful. To that end, we process the following personal data:

  • name;
  • address details;
  • email address;
  • telephone number;
  • Curriculum Vitae;
  • motivation letter;
  • salary indication;
  • references;
  • any other information that you enclose with your application.

We will retain your application details for a maximum of six weeks after the position has been filled. We will retain the data so that we will still be able to contact you should the position become vacant again within the trial period. If we are unable to offer you a position at this time, we can – with your consent – retain the application details for another year. You can withdraw your consent at any time by sending us an email. If you come to work with us, we will keep your application details in your personnel file. This file will be kept for as long as is necessary, and the application details will be retained for a maximum of two years after commencement of the employment.

A social media and Internet search may form part of the application procedure. This is required to ensure that our image is preserved when we take on new staff, and we therefore do this based on a legitimate interest. For this purpose, we will Google your name and look at any profiles you may have on the various social media. It goes without saying that we will only do so insofar as these profiles are public; we will not ask you to grant us access to a protected social media page or make a connection with us. The results of the searches will be discussed with you. If you object to this, you can indicate this by email at the time of your application.

Creating profiles

We combine your personal data from various sources in order to offer you the best online shopping experience. We do this by linking various data from you, such as your account details, order history, preferences and favourite jewellery specified by you, as well as your browsing behaviour on our or external websites.

Combining your data enables us to publish personalised offers and personalised content on the website or social media channels that match your interests and purchase history. It also enables us to personalise our newsletter for you. This means we can make more targeted offers on our website as well as through external advertisements.

We only create profiles with your consent. Our website uses cookies to collect and combine your data. Cookies provide us with information such as which pages on our website you have visited, which advertisements have been displayed to you on external websites and whether you looked at them or not, whether you are interested in discounts and which items you clicked on. The cookie table provides an overview of the cookies we use.

Provision of data to third parties

Buddha to Buddha only shares your data with third parties where this is permitted under the current legislation. We may provide your personal data to third parties because:

  • we have engaged them to process certain data;
  • this is required in order to perform the agreement with you;
  • you have provided permission for us to do so;
  • we have a legitimate interest in doing so;
  • we are legally obliged to do so (for example, if the police so demand in case of a suspected offence).

The parties that process personal data on our or your instruction are:

  • mail order companies;
  • distribution centre;
  • payment service providers;
  • cookie service providers;
  • administration and accounting firm;
  • software supplier;
  • IT suppliers and service providers;
  • marketing companies;
  • review companies.

In order to provide our services, Buddha to Buddha may provide your personal data to parties located outside the European Economic Area (EEA). Buddha to Buddha only does so if the personal data are processed with an appropriate level of protection. This means – for example – that we use a model agreement of the European Commission or make arrangements on the handling of personal data.

We are familiar with the judgment of the Court of Justice of the European Union of 16 July 2020 (the Schrems II case). We are currently investigating how we can best deal with this. We are very committed to privacy and will try to do everything we can to find a suitable solution. Once we have a suitable solution, we will inform you of this via this privacy statement. If you have questions about the processing of your personal data, please contact us using the contact details in this privacy statement.

Are your personal data protected?

Buddha to Buddha takes appropriate technical and organisational measures to protect against loss or any form of unlawful processing (such as unauthorised inspection, impairment, alteration or provision of personal data) in connection with the processing of personal data to be performed.

On our website, we use social media buttons which bring you to the social media platforms. This gives you the option of following us and sharing content within the network. You may also see advertisements on your social media page. The buttons work through pieces of code originating from your social media networks. If you want to know what the social media platforms do with your personal data, please read the relevant privacy statement:
